1. Information about the data controller of the data hosted on the official TRADEINN RETAIL SERVICES page on the social network

In accordance with the information duty established in Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD), TRADEINN RETAIL SERVICES, hereinafter the Controller, wishes to inform users of this social network about its policy regarding the processing and protection of the personal data of those individuals who voluntarily access and use the Controller’s official page on this social network. Access to and use of the Controller’s official page on the social network implies the user´s interaction with the platform and with the published content. The processing of personal data shall be carried out in accordance with this Privacy Policy and the terms and conditions established by the social network itself.

2. Data of minors or legally incapacitated persons

Access to and registration on this social network is prohibited for children under fourteen (14) years of age. Likewise, access to and use of the Controller’s official page on this social network by children under fourteen (14) years of age is prohibited. Furthermore, if the user lacks legal capacity, the Controller informs that the assisted consent of the holder of parental authority or guardianship over the user, or of the user´s legal representative, shall be required for access to and use of the Controller’s official page. The Controller shall be expressly exempt from any liability arising from the use of its official page by minors or legally incapacitated persons, such liability resting with their legal representatives in each case.

3. Identification of the Controller

The user is informed that the Controller, whose registered office is located at C/ Pirineus, 9 - 17460 Celrà (Girona), acts as the data controller of the personal data collected through its official page on the social network as a result of users´ interaction with it, without prejudice to the processing activities for which the entity operating the social network is responsible under its own privacy policies applicable to the social network where our official page is hosted.

4. Purposes of the processing of personal data, information and consent

The personal data voluntarily provided by the user to the Controller through its official page shall form part of a data processing activity for which the Controller is responsible, for the purpose of providing information about the Controller by e-mail, fax, SMS, social communities or any other electronic or physical means, present or future, that enables commercial communications, sending newsletters to users who subscribe, exchanging information with the Controller and other users, and establishing communications with third parties.

The user is free to use the Controller’s official page on this social network. Therefore, if the user does not agree with the processing of their data for the aforementioned purposes, they should refrain from using it or providing their personal data.

Through the Controller’s official page, the user may share texts, photographs, videos and other types of information and/or content, all of which shall be subject both to this Privacy Policy and to the Rules and Terms of the Platform. The user shall be responsible for ensuring that all content published complies with the applicable legislation, this Privacy Policy and the Platform Rules.

The user may only publish on the Controller’s official page personal data, photographs, information or other content of which they are the owner or holder of the corresponding rights, or for which they have obtained the necessary authorization from third parties.

The Controller shall have the right to remove from this official page—unilaterally and without prior notice to or authorization from the user—any content published by the user where the user breaches or infringes the applicable legislation, the provisions of this Privacy Policy or the Platform Rules.

5. Identification of recipients to whom the Controller intends to disclose or communicate personal data

The user is informed that all information and content published on the Controller’s official page on the social network may be viewed by the other users of the official page and the social networking platform. Consequently, all information and content published by the user on the Controller’s official page on this social network shall be disclosed to the remaining users by the very nature of the service.

The Controller only intends to disclose or communicate personal data where required to do so under the applicable legislation to judges, courts, public administrations and competent administrative authorities.

6. Other third-party service providers

The Controller informs the user that it is solely responsible for and guarantees the confidentiality, security and processing of data in accordance with this Privacy Policy with regard to the personal data collected from the user through this official page on the social network. The Controller assumes no responsibility for the processing of personal data carried out by the entity operating the social network or by third-party information society service providers that may access such data as a result of the provision of their services or the performance of their activities.

7. Data quality

The Controller informs the user that, unless legally authorised to act on behalf of another person, no user may use another person´s identity or communicate their personal data. Accordingly, the user must at all times bear in mind that they may only provide personal data relating to their own identity and that such data must be adequate, relevant, up to date, accurate and truthful. In any event, the user must respect the privacy of third parties, whether or not they are users of the social network or of the Controller’s official page.

8. Rights of the Data Subject

- Right to withdraw consent at any time.
- Right of access, rectification, data portability and erasure of personal data, and the right to restriction of or objection to processing.
- Right to lodge a complaint with the Supervisory Authority (www.aepd.es) if the user considers that the processing does not comply with the applicable legislation.

These rights may be exercised using the contact details provided in this Privacy Policy. Where the data are under the control of the social network itself, the exercise of such rights must be addressed directly to the relevant platform in accordance with its privacy policies.

The Controller may amend and/or replace this Privacy Policy at any time. Where applicable, such amendments shall replace, supplement and/or modify the version currently published herein. Accordingly, the user should consult this Privacy Policy periodically in order to remain informed of any updates.
