TRADEINN RETAIL SERVICES, the entity responsible for the website, hereinafter the “CONTROLLER”, makes this document available to users in order to comply with the obligations set out in Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSICE), Official State Gazette (BOE) No. 166, as well as to inform all users of the website about the applicable terms of use.

Any person who accesses this website assumes the role of user and undertakes to strictly observe and comply with the provisions set out herein, as well as with any other applicable legal provision.

TRADEINN RETAIL SERVICES reserves the right to modify any type of information that may appear on the website, without being obliged to give prior notice of or inform users of such modifications, it being understood that publication on the TRADEINN RETAIL SERVICES website is sufficient.

2. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The website, including, by way of example but not limitation, its programming, editing, compilation and other elements necessary for its operation, as well as the designs, logos, text and/or graphics, are the property of the CONTROLLER or, where applicable, the CONTROLLER holds a licence or express authorisation from the authors. All website content is duly protected by intellectual and industrial property legislation and registered in the corresponding public registers.

Regardless of the purpose for which they are intended, the total or partial reproduction, use, exploitation, distribution and commercialisation of such content requires, in all cases, the prior written authorisation of the CONTROLLER. Any use not previously authorised shall be considered a serious infringement of the author´s intellectual or industrial property rights.

The designs, logos, text and/or graphics belonging to third parties other than the CONTROLLER that may appear on the website are the property of their respective owners, who shall be responsible for any potential dispute that may arise in relation to them. The CONTROLLER expressly authorises third parties to link directly to specific content on the website and, in any event, to redirect users to the main website at www.tradeinn.com.

The CONTROLLER acknowledges the corresponding intellectual and industrial property rights in favour of their respective owners. Their mere mention or appearance on the website does not imply the existence of any rights or liability on the part of the CONTROLLER in relation to them, nor does it constitute any endorsement, sponsorship or recommendation thereof.

The CONTROLLER shall be exempt from any liability arising from information published on its website where such information has been altered or entered by a third party unrelated to the CONTROLLER.

Use of Cookies

This website may use technical cookies (small information files sent by the server to the computer of the person accessing the website) to perform certain functions that are considered essential for the proper functioning and display of the website. The cookies used are, in all cases, temporary and are solely intended to make browsing more efficient, disappearing when the user´s session ends. Under no circumstances do these cookies, by themselves, provide personal data, nor will they be used to collect such data.

Linking Policy

Since the CONTROLLER cannot always control the content published by third parties on their respective websites, it assumes no responsibility whatsoever for such content. In any event, the CONTROLLER will immediately remove any content that may contravene national or international legislation, public morality or public order, and will immediately remove the link to the relevant website, notifying the competent authorities of the content in question.

The CONTROLLER shall not be liable for information or content stored, including, by way of example but not limitation, in forums, chats, blog generators, comments, social networks or any other medium that allows third parties to independently publish content on the CONTROLLER´s website. However, in compliance with Articles 11 and 16 of the LSSICE, the CONTROLLER makes itself available to all users, authorities and law enforcement agencies, actively cooperating in the removal or, where appropriate, blocking of any content that may affect or contravene national or international legislation, third-party rights, public morality or public order. If a user considers that the website contains any content that could fall within this classification, they are requested to notify the website administrator immediately.

This website has been reviewed and tested to ensure that it functions correctly. In principle, proper operation can be guaranteed 365 days a year, 24 hours a day. However, the CONTROLLER cannot rule out the possibility of certain programming errors or the occurrence of force majeure events, natural disasters, strikes or similar circumstances that may make access to the website impossible.

IP Addresses

The website servers may automatically detect the IP address and domain name used by the user. An IP address is a number automatically assigned to a computer when it connects to the Internet. All this information is recorded in a duly registered server activity log, which allows the subsequent processing of the data solely for statistical measurement purposes, such as determining the number of page impressions, the number of visits to the web servers, the order of visits, the point of access, etc.

4. CHATBOT

This chatbot is a Tradeinn virtual assistant based on generative artificial intelligence, designed to provide general information and assistance regarding products, orders, deliveries, returns, warranties and other services offered by Tradeinn. Although Tradeinn works to ensure that the information provided by the virtual assistant is useful and accurate, the responses may not always be complete, accurate or up to date. For this reason, the information provided by the chatbot is for guidance purposes only and does not replace the contractual information provided during the purchase process, the General Terms and Conditions, the Privacy Policy or applicable legislation. Users should not enter particularly sensitive data or information that is not necessary for handling their enquiry into the chatbot. Likewise, the chatbot must not be used for unlawful, fraudulent or abusive purposes, or for purposes contrary to good faith or the terms of use of the service. Where necessary, users may request that their enquiry be reviewed, supplemented or referred to a human customer service agent. Tradeinn may update this notice where necessary to adapt it to technical, operational or regulatory changes.

5. APPLICABLE LAW AND JURISDICTION

The applicable law in the event of any dispute or conflict concerning the interpretation of the terms contained in the legal texts, as well as any matter relating to the services provided through this website, shall be Spanish law.
